Terms of Service

1. Eligibility

You must be able to form a legally binding contract to purchase or use PixelRec. If you use PixelRec on behalf of an organization, you represent that you are authorized to accept these Terms for it.

2. License grant

Subject to your payment and compliance with these Terms, PixelRec grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software:

• PixelRec Basic — for use on the number of devices stated at checkout (currently one device per license).
• PixelRec Pro — for personal and commercial creation of your own content, on the device(s) permitted by your license, including the feature set described on the product page at time of purchase.

Each license is delivered as a license key tied to your purchase email and may be activated up to the number of devices permitted for that product. We may offer paid upgrades between products.

3. Restrictions

You agree not to:

• copy, resell, sublicense, rent, lend, or redistribute the Software or your license key;
• share, publish, or circumvent license keys or activation limits;
• reverse engineer, decompile, or attempt to derive the source code, except where such restriction is prohibited by law;
• use the Software to infringe others' rights or to violate any applicable law.

4. Purchases & payment

Purchases are processed by our checkout provider, Gumroad, and are subject to Gumroad's terms in addition to ours. Prices are shown in US Dollars and may exclude taxes, which may be added at checkout based on your location. You are responsible for providing accurate purchase information. We may change prices and product features at any time, but changes will not affect purchases already completed.

5. Refunds

PixelRec is a digital product delivered immediately as a license key. If you experience a problem, contact us first at contact@pixelrec.com — we want you to be able to use what you bought. Eligible refund requests are handled through Gumroad. Except where a refund is required by law, refunds are provided at our reasonable discretion, generally within 14 days of purchase and where the license has not been abused.

6. Updates & support

We may release updates that add, change, or remove features. PixelRec Pro includes the future updates described on the product page at time of purchase. We provide reasonable support by email at contact@pixelrec.com. We do not guarantee that the Software will be compatible with every future version of Adobe Photoshop or every operating system.

7. Intellectual property

PixelRec, its website, branding, and Software are owned by PixelRec and protected by intellectual-property laws. These Terms grant you a license to use the Software, not ownership of it. Content you create using PixelRec belongs to you.

8. Third-party software & trademarks

PixelRec is a plugin that works with Adobe® Photoshop®. Adobe and Photoshop are trademarks of Adobe Inc. PixelRec is an independent product and is not affiliated with, endorsed by, or sponsored by Adobe. Your use of Photoshop is governed by Adobe's own terms.

9. Disclaimer of warranties

The Software and website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, PixelRec and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or content, arising from or related to your use of the Software. Our total liability for any claim relating to the Software will not exceed the amount you paid for it in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

We may suspend or revoke your license if you materially breach these Terms, including by sharing or abusing license keys. On termination, you must stop using the Software. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

12. Governing law

These Terms are governed by the laws applicable at PixelRec's principal place of business, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where mandatory local consumer-protection law provides otherwise.
